چکیده
در قوانين اساسي كه حاوي اصول مختلف و متنوعي است ، سه اصل بنيادي مهم كه حكومت مردم سالار بر پاية آن قرار دارد كه عبارتند از : نخست اصل اختصاص حق حاكميت مردم ، دوم اصل تفكيك و انفصال قواي حاكم از يكديگر به منظور برخورداري از مزاياي تقسيم كار از يك سو و جلوگيري از عدم تمركز غيراصولي قدرت در گروه حقوقي مشخص يا معين كه نهايتا منجر به تولد و رشد و نمو هيولاي استبداد خواهد شد و سوم اصل نظارت بر اعمال قواي حاكم بر كشور . در اين اصل اخير يعني مسالة نظارت بر اعمال قوه حاكم است كه بحث ما ادامه خواهد داشت . واقعيت قضيه اين است كه قوة قضائيه از بدو تولد همواره با نظارت و كنترل بر كيفيت اجراي قوانين در محاكم حقوقي توسط ديوان عالي كشور كنترل ميشد . اما موضوع نظارت بر اعمال قوه مقننه و مجريه تاريخچه ديگري دارد . در قوة مقننه كه مركب از نمايندگان مردم با استعدادها ، معلومات و تجارب مختلف و گرايشات گوناگون است امكان وضع قوانين و مقررات عادي در جهت مغاير و معارض با قوانين اساسي وجود دارد . بنابراين قوة مقننه در وضع قوانين بايد به كيفيتي كنترل شود و در قوة مجريه هم كه وظايف بيشماري را عهده دارد ، اين كنترل به منظور جلوگيري از انحراف از قانون و تصميم عدالت اجتماعي مي بايست وجود داشته باشد . بررسي تاريخ نشان ميدهد كه نخستين مرجع نظارت بر اعمال قوه مجريه تقريبا مقارن با انقلاب كبير فرانسه از سال ۱۸۰۰ ميلادي شروع به كار كرد و اكنون قريب دويست سال است از تاريخ فعاليت اين مرجع اداري وابسته به قوة مجريه ميگذرد و نتايج درخشان و اثار ارزنده ان به زودي از مرزهاي كشور فرانسه گذشت و كنسردتا يا شواري دولتي الگو و نمونهاي شد براي ساير كشورها بويژه در اروپاي غربي كه با تقليدي از كنسردتا و مقررات مربوط به ان به تاسيس شوراهاي دولتي همت گماشتند . كارنامه درخشان شوراي دولتي در كشور فرانسه بسيار حائز اهميت است ، آراي اين مرجع اغلب در دانشكدهها و مجامع حقوقي مورد بحث و تجزيه و تحليل قرار ميگيرد و در مواردي منشاء وضع قانون ميشود . اما وضع در كشور ما قبل از انقلاب به گونهاي ديگر بود . نظام حاكم تحت تاثير خصايص مستتر در خصلت يك حكومت ديكتاتوري به هيچ وجه علاقهاي به پذيرش امر و نهي فرشته عدالت نداشت و از انجا كه نميتوانست سيطره كنترل خود را به قوه قضائيه با توجه به پراكندگي محاكم و تعداد زياد قضات فراهم كند ، در مقاطع مختلف از طريق قوة مقننه كه بيشتر اعضاي ان منتصب حكومت بودند تا منتخب مردم به وضع قوانيني ميپرداخت و از طريق اين قوانين حدود صلاحيت قوة قضائيه را محدود ميكرد .
ABSTRACT
In the constitution, which contains a variety of principles, there are three fundamental principles underlying democratic rule: the principle of the right to sovereignty, the principle of secession and the separation of powers in order to enjoy the benefits of division. Working on the one hand and preventing the unreasonable decentralization of power within a specific or specific legal group that will ultimately lead to the rise and fall of despotic monstrosities, and third, the principle of monitoring the exercise of sovereign power over the country. It is in this latter principle, that is, the question of monitoring the exercise of the ruling power, that our discussion will continue. The fact of the matter is that the judiciary from birth has always been controlled by the Supreme Court with oversight and control over the quality of law enforcement in the courts of law. But the issue of overseeing the functioning of the legislature and the executive has a different history. The legislature, which is composed of representatives of people with different talents, knowledge and experience and diverse tendencies, is able to enact common laws and regulations in contravention of basic laws. Therefore, the legislative branch of law must be quality controlled, and in the executive branch, which performs numerous duties, this control must be in place to prevent deviations from the rule of law and social justice. A review of history shows that the first authority to oversee the exercise of executive power began almost in the wake of the French Revolution, and has been around for nearly two hundred years since the date of this executive branch’s affiliation, and its brilliant and valuable results. It soon crossed the French borders and became a model or model for government in other countries, especially in Western Europe, which sought to establish state councils by imitating the Concert and its regulations. The brilliant record of the State Council in France is very important, the opinions of which are often discussed and analyzed in law colleges and societies and in some cases the source of the law. But the situation in our country before the revolution was different. The ruling system, influenced by the peculiarities of a dictatorial state, had no interest in accepting the righteousness of the angel of justice and, since it could not confer jurisdiction over the judiciary given the dispersal of courts and the large number of judges. Through the legislature, most of which were members of the government, elected by the people to legislate, they restricted the jurisdiction of the judiciary.
